Push to Rewrite Genocide Law at ICJ Targets Israel

The Wall Street Journal is warning that the International Court of Justice may use its forthcoming ruling in The Gambia v. Myanmar to weaken the legal threshold for genocide in preparation for South Africa’s case against Israel. The Court has long required that, where genocidal intent is inferred from conduct rather than proved directly, it must be the “only reasonable inference” from the evidence. That guardrail is now under pressure from states and advocates seeking a more flexible standard. Ireland, intervening directly in South Africa v. Israel, made its objective explicit when it announced it would ask the ICJ to “broaden its interpretation of what constitutes the commission of genocide by a State.” It argued that genocidal intent can coexist with other aims, including military objectives.

However, Cornell Law professor Menachem Rosensaft maintains that Ireland’s proposed reinterpretation in the Israel case, echoed in its intervention in The Gambia v. Myanmar, runs against nearly 80 years of genocide law and risks “watering down the definition of genocide.”

Indeed, the stakes are significant. The Genocide Convention’s drafters specifically warned that “the infliction of losses, even heavy losses, on the civilian population in the course of operations of war” does not ordinarily constitute genocide, because such losses belong to “the regulation of the conditions of war and not to that of genocide.” If genocidal intent could be inferred despite plausible alternative explanations for wartime conduct, virtually any war fought in densely populated areas with substantial civilian casualties could be recast as genocide.

A Wall Street Journal op-ed by Orde Kittrie and Andres Muñoz-Mosquera suggests that lowering the threshold is the “express goal of some advocates” precisely because it would pave the way for a genocide finding against Israel.
